In the second case, they overturned a Wisconsin law that increased penalties for forcible sex

In the past year, feminists have celebrated the court’s failure to give men any rights, but not the men who seek to overturn the court’s ruling in favor of Virginia couple, Marc and Nancy Spears.

On one level, these are two different cases. New York University’s Marc N. and Nancy H. v. Jerri is about whether a prosecutor should have to prove that the accuser was “credible” in order to prove beyond a reasonable doubt that a rape occurred. Wisconsin v. Galloway is about whether a prosecutor can force a city councilwoman to take a public stand on an issue she might believe is controversial. Both cases have to do with the issue of perception.

But in reality, they are linked. Galloway is actually a continuation of the Spears case and not the other way around. In the year since George W. Bush appointed Justice John Paul Stevens to replace the retiring Justice Anthony M. Kennedy, the men’s rights activists have found a new way to get Kennedy off of their backs.

In both the Galloway and Spears cases, the men’s rights activists have tried to get the court to consider a legal issue it has not addressed in more than a century: whether a woman’s “credibility” can be up for grabs, and by implication, a man’s too.
