Johannesburg – The family of a young boy who was killed in a crash in Durban two years ago have called on authorities to review its policy regarding alcohol in urban areas.

The family of 15-year-old Mamdani Maleka said their main request is for an audit of drink-driving laws in the province because the boy died from severe head injuries after being hit by a vehicle driven by a drunk driver.

“Our main concern is to see if alcohol levels were above 0.04 in the case of the driver who struck him,” said Johan Botha, his brother.

Johan Botha said he was shocked by the news of the man’s release last week from prison after serving four months of a 12-month sentence for culpable homicide.

His family’s request for a review of the 0.04 blood alcohol limit in urban areas was made at a meeting of the SA Road Safety Commission in Johannesburg on Thursday.

“The original road safety commission, which is the body that makes the decisions, says that because of various reasons that it is decided that the alcohol limit will be set at 0.04, and that is a decision that has not been changed in the past,” said deputy chairperson Dr Phuti Makhanya.

“There are no reasons for the decision to be changed.”

He said it was possible for the commission to start an investigation into the decision made by the Road Safety Act, which was to decide that the alcohol limit in urban areas should remain at 0.04.

“One of the powers of the commission is to investigate, and they are investigating now, and will make recommendations, and the recommendations will be made to government,” he said.

“As I understand it, they have found that there are various reasons why this decision has been made. The commission needs to find out about these reasons.”

A number of members of the public said that there should be a review of the law.

“In my opinion, we need to review the alcohol limit, because in the case of Mamdani we have had drunk drivers come out of prison after getting a 12-month sentence, and we don’t need drunk drivers on our roads,” said Marietta Silikula, a community safety worker.

“In the case of Mamdani, we are talking about a tragic, tragic incident.”
